To use the Service, you must have a valid SMS-enabled mobile device and an active mobile phone plan. You are responsible for all charges associated with sending and receiving SMS messages to and from the Service. You are also responsible for ensuring that your mobile device is compatible with the Service.
The Service may allow you to submit, upload, publish or otherwise make available content, including but not limited to text, photographs, videos and audio (collectively, "User Content"). You retain all rights in your User Content and are responsible for its accuracy, legality, and appropriateness. By making any User Content available through the Service, you grant to Mesmo a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Service and Mesmo's business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
The Service and its content, features and functionality, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by Mesmo, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. These Terms grant you no right, title or interest in the Service or any content, features or functionality made available through the Service, including any intellectual property rights.
The Service is provided on an "as is" and "as available" basis. Mesmo makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials or products included on the Service. You expressly agree that your use of the Service is at your sole risk.
In no event shall Mesmo or its affiliates, or their directors, employees, agents, partners, suppliers, or content providers, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, good-will, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
In no event shall Mesmo's aggregate liability exceed the greater of one hundred dollars (USD 100) or the amount you paid Mesmo, if any, in the past twelve months for the Service giving rise to the claim.The limitations of liability set forth above shall apply even if your remedy fails of its essential purpose. The Service is controlled and operated from facilities in the United States. Mesmo makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable United States and local laws and regulations, including but not limited to export and import regulations.You acknowledge that data rates may apply to your use of the Service.
